A class action has been certified by the Ontario Superior Court of Justice on behalf of all persons who became Crown wards in Ontario on or after January 1, 1966. The class has been defined to include all individuals who were Crown wards in Ontario at any time between January 1, 1966 and March 30, 2017.
The claim alleges that Ontario breached duties owed to the class and was negligent in its failure to take steps to protect and pursue Crown wards’ rights to apply for compensation from the Criminal Injuries Compensation Board and to commence civil proceedings for damages sustained as a result of criminal or tortious acts.
Although Ontario does not admit any liability, the parties have agreed to a proposed settlement of this class action. The proposed settlement will need to be approved by the Court before it is finalized.
A settlement approval hearing has been scheduled for May 12, 2021.
